General Terms and Conditions of AMBER HOTELS

  1. Conclusion of contract

    1. 1.1 A contract is concluded between the client and AMBER HOTEL subject to the following conditions as soon as the bedroom(s), rooms, function space or other services have been ordered by the client and accepted by AMBER. The same applies when AMBER confirms bookings in writing and this is followed by reconfirmation by the client.

    2. 1.2 If AMBER requests a down payment or an advance payment for the reservation and this is not paid promptly within the prescribed timeframe, then the reservation commitment shall be rendered invalid.

    3. 1.3 If the person making the booking is acting in a commercial capacity on behalf of those guests or attendees for whom the reservations are being made, he shall be held responsible for any liabilities incurred herewith.

    4. 1.4 If the reservation confirmation deviates from the content of the reservation requested, then the content of the reservation confirmation shall become the contractual content insofar as the guest approves this or the services are accepted without objection.

    5. 1.5 In the case of reservations for several persons, for groups, tours, seminars or conferences, AMBER must be notified of the number of persons and, where possible, given a list of attendees at least three days prior to arrival or start of the function. Political functions must be clearly declared as such at the time of booking.

    6. 1.6 Rooms, display cases and other space are hired for a suitable remuneration. They may only be made available to third parties with AMBER's consent.

  2. Check In / Check Out

    1. 2.1 Unless otherwise agreed, check in should be after 3.00 p.m. on the day of arrival and check out should be before 11.00 a.m. on the day of departure.

    2. 2.2 In the event that the guest intends to vacate the room after 11:00 a.m., the guest shall notify the reception desk of this. Insofar as AMBER approves this, if no deviating agreement has been concluded, half of the room price must be paid if the guest vacates the room by 6:00 p.m. and the full room price must be paid if the guest vacates the room after 6:00 p.m.

    3. 2.3 For reserved bedrooms, check in should be by 6.00 p.m. at the latest. Otherwise AMBER is no longer bound to hold the rooms. This does not apply to: Reservations that have been paid in advance or for which a voucher has been issued or for which a credit card number from a credit card company accepted by AMBER has been received.

  3. Services

    1. 3.1 The services that the hotel has contracted to provide are either those set out in the hotel's brochure or as agreed with the client.

    2. 3.2 If full board has been agreed with the guest and the guest is served lunch on the first day, the hotel's contractual obligation ends with breakfast on the day of departure, otherwise with lunch. Half board generally consists of breakfast and dinner.

    3. 3.3 If the guest does not partake of any meal, for any reason whatever, he cannot claim a refund, not even pro rata, or a reduction in the price.

    4. 3.4 The prices contained in the brochure or other lists include service and valueadded tax at the current rate. Should the rate of value-added tax be altered during the period of the contract, AMBER is entitled to adjust the prices to reflect the new rate of value-added tax.

    5. 3.5 The hotel's prices and tariffs do not included visitor's tax.

    6. 3.6 For functions that continue beyond the agreed time, a surcharge calculated on the basis of hourly rate + other costs + extra rate for night work (where applicable) will be charged for every member of staff involved.

  4. Payment

    1. 4.1 Unless otherwise agreed, in the case of reservations payment is due upon arrival or upon departure of the guest.

    2. 4.2 For a stay of more than 3 days, AMBER can issue an interim invoice.

    3. 4.3 If the guest is late with his payment, then the hotel may rescind the agreement with immediate validity. AMBER reserves the right to assert claims for any more extensive damages, particularly for the loss of any other rental amounts.

    4. 4.4 If a guest cuts short his stay, he is still liable for payment of the full amount, unless he can prove that AMBER has failed to avail itself of a suitable opportunity to relet the room(s).

    5. 4.5 The place of performance for the guest's payment obligations is the registered office of the hotel. This also applies if the guest has been granted credit facilities.

    6. 4.6 Payments by credit card, cheque or banker's draft are subject to clearance.

  5. Cancellations

    1. Unless otherwise agreed, reservations can be cancelled as follows:

      1. 5.1 Accommodation for up to 14 persons:

        1. 5.1.1 Arrangements: It is possible to cancel the reservation up to the 22nd day before the scheduled arrival date without incurring any costs. If cancellation is made between the 15th and 21st day before the scheduled arrival date, AMBER shall charge 50% of the arrangement price. If cancellation is made between the 4th and 14th day before the scheduled arrival date, 70% of the arrangement price shall be charged. If cancellation is made three days or less before the scheduled arrival date, 80% of the same shall be charged. If the guest fails to appear to take the room, then 90% of the price shall be charged.

        2. 5.1.2 Hotel room: It is possible to make cancellation up to the 2nd day before the scheduled arrival date without incurring any costs. If cancellations are made after the 2nd day before the scheduled arrival date or in the event that the guest fails to appear to take the room, then the price for the first night of lodging shall be charged. Exceptions to this policy shall be the timeframes for a trade fair or other large events in the region which are indicated upon the reservation confirmation. During these timeframes, cancellation may be made merely up to the 30th day before the scheduled arrival date without incurring any charges. Otherwise, AMBER shall charge 80% of the lodging costs for the timeframe booked.

      2. 5.2 Lodging for at least 15 persons (group arrangements). Cancellation may be made upon a free-of-charge basis if it is made up to 30 days before the scheduled arrival date. If cancellation is made up to 20 days before the scheduled arrival date, then 20% of the lodging or arrangement price shall be charged. If cancellation is made up to 10 days before the scheduled arrival date, 80% of the same shall be charged. If cancellation is made up to 3 days before the scheduled arrival date, 90% of the lodging or arrangement price shall be charged.

      3. 5.3 If the reservation totals more than 200 nights‘ accommodation, the above periods shall be extended by 5 days.

      4. 5.4 Functions: For agreed functions and the allocation of rooms therefore the following cancellation periods shall apply:

        • Over 30 days: no hire costs will be charged.

        • Between 29 and 15 days: hire costs will be charged.

        • Between 14 and 8 days: hire costs plus reimbursement of 33% of lost sales (food); if agreement on this had not been finalized, the minimum banquet menu price x number of persons shall apply.

        • Between 7 and 3 days: hire costs plus reimbursement of 66% of lost sales (food); if agreement on this had not been finalized, the minimum banquet menu price x number of persons shall apply.

        • Within 72 hours: hire costs plus reimbursement of 80% of lost sales (food); if agreement on this had not been finalized, the minimum banquet menu price x number of persons shall apply.

  6. Liability

    1. 6.1 The client or function organiser shall be responsible to AMBER for any damage caused by him or his guests.

    2. 6.2 AMBER shall not be liable to the guest or the contracting party if it is unable to provide the services agreed due to industrial action or Act of God. In this event, AMBER shall endeavour to find another provider of similar services.

    3. 6.3 AMBER shall be liable to the guest in accordance with the provisions of the BGB [German Civil Code] (up to 100 times the room price, but nonetheless a maximum of 3,500 €); for money and valuables as specified in § 702 BGB, AMBER shall nonetheless assume liability only up to 800 € unless AMBER or its personnel has culpability or the money or valuables were surrendered to AMBER for safekeeping and a receipt was issued to the guest for them.

    4. 6.4 If the guest brings along a passenger vehicle and parks it in a parking lot provided by AMBER, then AMBER's liability shall be limited as prescribed in the relevant liability insurance policies that have been concluded by AMBER. In particular, no surveillance agreement has been concluded.

    5. 6.5 In the event of functions, it is the responsibility of the contracting party to insure any articles brought into the hotel against theft or damage. AMBER accepts no responsibility.

  7. Notice of termination

    1. 7.1 If the guest uses the rooms provided to him for any other purpose than the agreed purpose, then AMBER shall be entitled to make extraordinary termination.

    2. 7.2 If AMBER has good reason to assume that a function will jeopardize the smooth running of the hotel, its reputation or the security of its guests, also in the event of an Act of God or civil commotion, AMBER can also terminate the contract with immediate effect.

    3. 7.3 The same applies if an organiser places advertisements in a daily newspaper inviting people to attend interviews or sales events without AMBER's consent. In this case AMBER is entitled to demand the agreed hire charge in the event of termination.

  8. Miscellaneous

    1. 8.1 Animals may be brought onto AMBER's premises only after having received AMBER's prior consent to do so and a surcharge is billed for them. Animals may not be brought along into public areas of the premises such as the restaurant, bar, club, sauna, etc.

    2. 8.2 Services such as early morning calls, the provision of information, the delivery of mail and packages are all provided without obligation. The guest cannot infer any claims of any kind from the provision of these services.

    3. 8.3 Lost property (property left behind) will be sent on upon request at the guest's expense. Articles will be kept for a period of 6 month.

    4. 8.4 In the event that AMBER transports a guest upon a free-of-charge basis, then its liability shall be limited for personal injury and property damage as prescribed in the insurance concluded for the passenger vehicle.

    5. 8.5 In the event of functions, guests are strictly forbidden to bring food and drink into the hotel for consumption on the premises. Any declaration of function rooms other than the normal table decoration requires a separate agreement.

  9. General

    1. 9.1 AMBER reserves the right to correct errors, including typographical and calculation errors.

    2. 9.2 Verbal agreements are only binding once they have been confirmed in writing by AMBER.

    3. 9.3 Insofar as this is legally permitted, the commercial residence of the hotel is agreed to be prevailing for any disputes arising from this agreement and its fulfilment.

    4. 9.4 In the event that one of the aforementioned provisions is invalid, then this shall not affect the validity of the remaining provisions. In place of the invalid provision, a valid provision shall be agreed which most closely corresponds to the intent of the invalid provision.
